We assist with unopposed and opposed divorces, but our fees range within a fixed rate for unopposed divorces.

An unopposed divorce occurs when both parties agree on all terms, such as asset division, pension, maintenance, and child custody. The process begins with filing a summons and particulars of claim in the relevant court. If the defendant consents or does not oppose within the stipulated time, or signs a settlement agreement, the matter is set down for a hearing. Both parties or their legal representatives appear before the court to confirm the settlement agreement. The court reviews the agreement, ensuring it protects children’s interests and complies with legal requirements. Once satisfied, the court grants a final divorce order, concluding the process swiftly and amicably.

Our legal services include the court process for debt review removals. If a consumer seeks removal from debt review without completing repayment, they must apply to the Magistrate’s Court.

The application requires evidence that they are no longer over-indebted, typically including updated financial assessments and proof of affordability. The court evaluates whether the consumer can meet their original credit obligations. Creditors may oppose the application, presenting their own evidence. If the court is satisfied, it issues an order removing the consumer from debt review. This decision is communicated to the debt counsellor and credit bureaus. Once removed, the consumer regains normal credit status but remains responsible for any outstanding debts.
Application with No Assets

Voluntary sequestration allows a debtor to declare insolvency when unable to repay debts. If they have no assets, the process requires demonstrating that sequestration will benefit creditors. The debtor files a High Court application, supported by a statement of affairs, financial disclosures, and an affidavit. A provisional sequestration order is issued if the court is satisfied. The debtor must notify creditors and advertise the order. Creditors may oppose if no advantage is evident. If successful, a final sequestration order is granted, and a trustee is appointed to manage any recoverable income. Debts are discharged, but the debtor remains insolvent until rehabilitation.

The Debt Review Process is governed by the NCA (National Credit Act and aims to assist over-indebted consumers. The process begins when a consumer applies to a registered debt counsellor. The counsellor assesses their financial situation to determine over-indebtedness. If confirmed, the counsellor notifies creditors and negotiates reduced repayment terms to ensure affordability while fulfilling obligations. A repayment plan is drafted and submitted to the Magistrate’s Court for approval. Once approved, creditors cannot take enforcement action, provided the consumer adheres to the new plan. Upon successful completion, the consumer receives a clearance certificate, enabling them to exit debt review and regain financial freedom.

Our team includes a registered Debt Counsellor who can provide the services of declaring the consumer’s financial obligations as over-indebted.

Settling disputes should not always be expensive and timeconsuming. We believe in amicably resolving our client’s
issues rather than jumping straight to court. Alternative
dispute resolution has proved to be effective in addressing
labour disputes, family disputes, contractual disputes and so
forth. This is an opportunity for an aggrieved party to
substitute the lengthy functioning and formal dispute
resolution system, and or court processes with more flexible
and easily accessible processes of fostering peace. This
solution has emerged as a way to avoid court litigation
processes in that litigation would be the last resort and only
used in cases where it is absolutely necessary.

ADR has emerged as a way to avoid court litigation processes in that litigation would be the last resort and only used in cases where it’s absolutely necessary.
